Action Alert: EPA Suspends Industry Regulations During COVID-19

During this crisis, the Trump administration is silently sneaking through more and more environmental rollbacks that bolster industrial profits over environmental and human health. On March 13th, the Environmental Protection Agency (EPA) issued an order to indefinitely suspend enforcement actions for companies normally regulated under the Clean Air and Clean Water Acts in light of the COVID-19 pandemic. While facilities such as refineries and chemical plants continue to operate during the pandemic, they are no longer required to report when their factories discharge certain levels of pollution into the air or water.

From the order itself:  “In general, the EPA does not expect to seek penalties for violations of routine compliance monitoring, integrity testing, sampling, laboratory analysis, training, and reporting or certification obligations in situations where the EPA agrees that COVID-19 was the cause of the noncompliance and the entity provides supporting documentation to the EPA upon request.”

This gives a free pass to companies to pollute in violation of environmental laws for an indefinite period. This is unacceptable, especially given that many industrial hotspots are centered in already vulnerable at-risk communities. [2]
